I don't know what you would have done differently (except maybe a mighty blast on a Stebel airhorn ). As the fellow to the left dropped back to change lanes, it seems he should have easily seen the other lane (your lane) wasn't clear. I presume he was simply trying to push his way in.

At the time I was thinking a "Stebel" would be perfect right now! It does look like he's not caring I'm there. I don't have the nads to lane split just yet but i'm leaning that way.

I don't see anything you did wrong, except maybe hang out in his blind spot.
Makes no excuse for the car changing lanes, only a suggestion for future.
So in this case I'd do one of two things; first, go to the left side of the lane, as this puts you in his side mirror, and second, fall back. I don't follow as closely as you were, though I do see traffic was very slow (I don't see that much traffic, frankly).

BMW. Don't you know he owns the road? You're supposed to defer to him, always. He doesn't have to look; everyone is supposed to get out of his way. After all, he spent more on his car so he deserves more of the road.

No, really. The guy is a bad driver. Even if you were momentarily in his blind spot, your lights were bright enough to give him a clue that the lane wasn't empty. I'm just glad you're OK. It seems like you did everything right- anticipated the crummy driver and got out of his way fast without endangering anyone else. And you didn't even raise a "one finger salute"! Well done.

Ignoring the reason why the driver didn't see you, once it became obvious that the vehicle was coming into the lane, if I'd been in your position on either my MP3 or bike I'd have backed off and let the driver do what they wanted. Why? Any situation where it is car versus bike/scooter, the bike/scooter is going to come out of the situation worse off than the car. And that's not taking into account the damage to the rider...

Iím reminded of an adage I was taught a long time ago in school bus driver training:

You do not have right of way - you can only be given it. Legally, you may have right of way, but if the other driver doesnít grant it, you have an accident. Not good with 45 kids on board and not good on 2 or 3 wheels.

MSF training

you were riding in the center of the lane thus leaving your lane partial open on the left. This gave the person in the car an opportunity to merge into your lane.

Your following distance was also a bit too close. I know its tough to maintain in heavy traffic.

Did you do anything technically wrong? No. The car did wrong by not fully ensuring the lane they wanted in was clear prior to merging.

honestly, and this is my opinion, you following distance was too close to the car in front. Don't know the speed at which you were riding, but distance too close.

I also think that the 5er driver does not have his mirrors properly adjusted either. his side mirrors are probably adjusted so that he can see the back of his car. If properly adjusted, he might have seen you. Also, you were further right in the lane which could have been a potential cause.

I do appreciate the fact you were wearing brightly colored jacket because that is a lot of problem with riders. dark clothes look cool.
