Ive seen bent quadrant shafts that would stay in the down position like that but, you could always raise it back up with your foot.

If that thing is locked solid and theres no way to move it up/ down, then something internal is jamming it. Could be metal, could be rubber. No easy way of knowing. Only way to fix it would be to split the engine cases!

The lever will strip its spines if it is under- or over-tightened. Is the mechanism itself not returning or is the lever stripped?

Best case, Lever has stripped its splines. Worst case jammed inside, and needs the motor opened up.
I'd pull the lever off and check the splines. it should be obvious, a lot of shiny aluminum splinters. I hope that is it , it's the easier of the fixes. Good luck!

At least now you can get a period correct kickstart lever. They make a T5 splined old style.

To confirm it's just the lever, bump start it and see if it sounds ok.
