That is too funny! I wonder if the police noticed this as well. I sure didn't but I have never seen anyone spell Jenkins with a "G" before. Dumb asses!

XLR8 wrote: That pitiful excuse for a receipt won't hold up as proof that they bought that scooter from anyone. You should push hard on the District Attorney's Office to prosecute the dealer. The dealer should (at the very least) lose his license to sell new & used motor vehicles. Chances are that an employee of the dealership stole the scooter and a good prosecutor would go after the dealership to send a message to others who might try the same thing. You also probably have a good basis for a civil suit for the money that you are out. Since the dealer can't prove that they bought the scooter from anyone and since they were in possession of the scooter and attempting to sell it, the onus is actually on them to prove that they didn't steal the scooter. i.e., you could sue the thief (the owner of the dealership) for stealing your scooter and the money you are out. I hope the D.A. throws the book at them. it is pitty people steal goods of others. This is not the first time the dealer accepts and slaes stolen wehicles! the law court should cansel his trade licence. We have nearly the same problems in Turkey people can buy and sale stolen goods and the law applies only poor penalties which gives more power to the burglars. |

What was the VIN Does anyone (other than me) question the accusations made against the dealer in question? I mean really ... we need to be fair here! If these accusations are unfounded, then I (and many others) owe this dealer a profuse apology! We all took the OP at face value but we have not seen any valid follow up or any proof (of any kind) showing that the dealer had any involvement in any wrong doings at all. Personally ... I am really starting to wonder and I am also starting to feel very badly about this whole thing! Anyone else? |

TrafficJammer: The wheels of justice grind very, very slowly and it is not uncommon for incidents like this to take quite a while before getting some resolution.
The detectives or the D.A. could have also asked Whitty to NOT discuss this with anyone else at this point. Who knows? But, I don't think for one moment that Whitty made up this story. There have been other posters in this three page thread (including the former owner of the dealership) that indicate that there are problems. I have a friend who is a detective and he said that it will sometimes take six to nine months for the police and the D.A.'s office to get all their ducks in a row for formal charges to be filed with some cases. He used the case of the woman in FL where her daughter was missing for months before they charged her for murder even though they were positive that she had killed her. None of us can rush the police or the D.A. and I suspect that we will see some concrete results after the first of the year (if not before). |

Quote: The detectives or the D.A. could have also asked Whitty to NOT discuss this with anyone else at this point. Who knows? Quote: The detective said he should have it (referring to the case against the dealer) finished up by the end of this week. The wheels are turning, albeit very slowly. I'll let you know when I hear more. I have no doubt that the scooter was stolen and that the circumstances surrounding finding the scooter on the dealers premises were on the up and up ... but it is the rest of it I wonder about. It has now been more than 2 months since Whitty's last post on the topic. I am more than surprised that no formal charges have been made against the dealer by now if there was suspicious activity there! Surely, the police had sufficient evidence to charge the dealer with "handling stolen goods" ... if nothing else! Admittedly though, I know nothing about U.S. justice or what it takes to build a case there. If what Whitty reported had happened here, the dealer would definitely have been charged with handling stolen goods within a week or two of identifying the scooter. Further charges would have been laid as and when additional info/evidence against him (or any employees at the dealership) presented itself while the investigation progressed. If these accusations are true and if the dealer (or one of his employees) was knowingly involved in a scooter theft ring, I find it odd that the police would allow him to continue to keep the dealership open, possibly putting other unsuspecting buyers at risk. Their website is still up and running and it has been updated continually since this thread appeared. I'm just saying ... maybe this case is not as cut and dried as it appeared on the surface and perhaps we all jumped to conclusions too readily? |

I sent a PM to Whitty and got this reply:
"I've called and called and called. No return calls. I haven't forgotten about it and I'm trying to make sure that they haven't either. Thanks for asking. I'll post as soon as I know something more. Sorry." Whitty can't pull a rabbit out of a hat and I personally wouldn't buy so much as an oil filter from this dealer based on what I've read in this thread. YMMV |

Fair enough XLR8 ... just wanted to be sure we weren't crucifying someone unjustly!
I am in a service business and have seen other companies damaged badly by unfair (or one sided) accusations. As whitty had sort of disappeared, it made me wonder if we were all being a little too quick to draw very negative conclusions about this guy. Glad the case is still "in progress" but am amazed at how long it seems to be taking! As I said, if that had happened here, the dealer would have been charged with handling stolen property within a week or two of finding the scooter on his premises! |

Not saying the dealer is clean, but I'm not sure what obligation was owed by the dealer, or anyone else at that point, to the OP if she had collected on her policy. |

Technically the insurance co owns the scooter now, and typically would sell it with a salvage title at auction. Clearly this scooter was not purchased at auction by the dealer in question.

On the other hand, as gray as it sounds, the dealer may be able to prove that it was a legitimate buy. We will just have to wait and see. I may have missed it, but where is the scooter now? Was it taken as evidence? If not, then there seems to be something strange going on. |

I don't mean to dig up an old grave, but I just wanted to let everyone know that I drove by Vespa Charlottesville a few days ago and peeked inside. All of the bikes are gone except for a KTM bike, what looks to be an 06 BV500 and an (07?) GTS250ie.
I recognized the BV as a used scoot that the dealer had for quite some time. I think the other two bikes are used as well. |
