Hearing loss from riding has been brought up a couple of times recently.

I thought some actual facts, or I guess I should say facts from a 'Pro-Hearing,' group, should be presented.

If there is a group that is against hearing, I welcome someone to provide a link so we can read their side of things, send me a link and I'll edit this so they are side by side, and MVers will have all the information in one place.

I'm not suggesting you should wear hearing protection. I'm suggesting that before making a decision, you read about the conclusions from one group about riding and hearing loss.

Check your state code and read what it says about anything like (d) below.

AMA info is not perfect, because here is the Ca VC

(a) A person operating authorized emergency vehicles, as defined in Section 165.

(b) A person engaged in the operation of either special construction equipment or equipment for use in the maintenance of any highway.

(c) A person engaged in the operation of refuse collection equipment who is wearing a safety headset or safety earplugs.

(d) A person wearing personal hearing protectors in the form of earplugs or molds that are specifically designed to attenuate injurious noise levels. The plugs or molds shall be designed in a manner so as to not inhibit the wearer's ability to hear a siren or horn from an emergency vehicle or a horn from another motor vehicle.

(e) A person using a prosthetic device that aids the hard of hearing.
Maryland laws are very similar to Ca:
Quote:
ยง 21-1210. Wearing earplugs, headsets, etc., prohibited.

(a) Wearing headset coverings.- A person may not operate a bicycle, an EPAMD, or a motor scooter on any highway, or on any roadway, while the person is wearing any headset covering both ears.

(b) Earplugs.- A person may not operate a bicycle, an EPAMD, or a motor scooter on any highway, or on any roadway, while the person is wearing any earplugs in both ears.

(c) Exceptions.- The provisions of this section do not apply to:

(1) Any person wearing personal hearing protectors in the form of custom earplugs or molds that are designed to attenuate injurious noise levels, if the custom plugs or molds are designed in such a manner as to not inhibit the wearer's ability to hear a siren or horn from an emergency vehicle or a horn from another vehicle;

(2) Any person wearing a prosthetic device used to aid the hard of hearing; or

(3) Any person operating a bicycle on a public bicycle pathway expressly authorized for the use of persons operating bicycles.
MD law does not provide a definition of custom- as far as I could find- and I'm not associated with the law in any way.

Custom to me would be getting the little foam guys warm so they custom fit to your ear canal. If you are concerned, perhaps adding a print out of the page and code, and sticking it in the ziploc baggie with your reg and insurance would be a good idea.

A reasonable person (you, officer, judge, the Gov.,) would want you to protect your hearing, rather than becoming a burden on the state. A reasonable person would also know which set of earplugs kills too much noise, and which set does not - when properly installed.

Prohibited or not (and probably not) I can't see a law which ostensibly requires people to go deaf as having much constitutional validity.
